1. Acceptance of Terms

By creating an account or using WerdSpark (the “Service”), you accept and agree to be bound by the terms of this agreement. If you do not agree, do not use the Service.

2. What the Service Is

WerdSpark helps you draft messages for real-world situations — hard conversations, follow-ups, replies you do not want to write. It generates suggested text based on the situation, recipient, and tone you provide. The output is a starting point, not a finished product, and not legal, financial, medical, or other professional advice.

3. Your Account and Security

• You are responsible for the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• We may suspend or terminate accounts that violate these terms or engage in abuse.

4. User Responsibility

You are responsible for how you use generated messages. You assume full responsibility for:

• Reviewing and editing any message before you send it
• The consequences of sending messages based on our suggestions
• Ensuring messages are truthful, lawful, and honest
• Any conflict, harm, or professional consequence resulting from message use

We are not liable for interpersonal conflicts, relationship damage, or professional consequences resulting from your use of generated content.

5. Payment and Access

• A free tier allows 10 generated messages per month, no card required.
• Premium is a recurring subscription of $3.00 USD per month that unlocks unlimited generations while active. It renews automatically each month until you cancel.
• You may cancel at any time. Cancellation stops future charges; Premium access continues until the end of the billing period you have already paid for, then reverts to the free tier.
• If a renewal payment fails, Premium access reverts to the free tier until payment succeeds.
• All prices are in USD. Payments are processed by Stripe. We never see or store your card details.

6. Refund Policy

You can cancel at any time to stop future charges. Because access is delivered instantly, refunds of charges already made are limited to:

• Charged twice for the same billing period — we will refund the duplicate charge.
• The Service failed to deliver Premium access after a confirmed payment — we will refund or restore access.
• Any other billing dispute — contact support with evidence.

Refund requests must be made within 7 days of the charge in question.

7. Your Content and Intellectual Property

You own the messages you generate and may use them freely for personal and business purposes. You may not:

• Resell or redistribute the Service itself
• Use the Service to infringe the rights of others
• Represent AI-generated content as human-written in a misleading or deceptive way where disclosure is required

8. Prohibited Uses

You agree not to use the Service for:

• Harassment, abuse, or threats
• Fraud, scams, or deception
• Illegal purposes
• Spam or unsolicited mass communications
• Impersonation or identity theft

9. Availability and Changes

We may modify, suspend, or discontinue the Service. We may update these terms by revising this page; material changes affecting existing customers will be announced on the site. Continued use after changes constitutes acceptance.

10. Limitation of Liability

To the maximum extent permitted by law, WerdSpark and its suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or business, arising from your use of or inability to use the Service, even if advised of the possibility of such damages.

11. Governing Law

These terms are governed by the laws of the State of New York, USA, without regard to conflict-of-law principles.
